Terms of Service


By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Highland School of Motoring - ABN 41 876 007 973.

Highland School of Motoring reserves the right to update and change the Terms of Service without notice.


1. General Conditions

1.1 Driving lessons are provided by Highland School of Motoring (ABN 41876007973) of Cambooya, QLD, 4358. These terms govern the agreement between the learner driver ("you") and Highland School of Motoring. By booking a driving lesson ("Lesson"), you accept these terms and conditions ("Terms").

1.2 These Terms may be varied from time to time and will be updated on the website at www.highlandsom.com.au. You will be bound by these Terms you accept at the time of booking your lesson. If you book more than one lesson at the same time, the terms and conditions applicable at the time of booking will apply to each lesson booked at that time.

2. Lesson Bookings

2.1 Lessons must be booked via one of the following platforms: 
a. Highland School of Motoring office directly on 0419 119 323, or
b. Highland School of Motoring online booking system.

2.2 Standard lesson bookings must be made at least 12 hours prior to lesson time pending instructor availability. Lesson must be paid for prior to or at the beginning of the lesson.

2.3 Duration of lessons includes briefing and de-briefing time. Lessons commence at a pick-up point determined at the time of booking unless otherwise agreed with the Instructor.

2.4 Current charges for our lessons are published on our website.

3. Payment Conditions

3.1 All bookings must be paid for in full prior to the commencement of the lesson. The Instructor is not obliged to provide you with a lesson if the lesson fee has not been paid in full.

3.2 Payment can be made by cash, Direct Deposit or Eftpos. Payment acceptance varies by booking channel and is agreed upon at the time of a booking.  Eftpos payments attract a $1.00 Transaction fee.

3.3 By booking a lesson, you warrant to us that you are 18 or more years of age, and if younger, you possess legal parental or guardian consent and that you are authorised and able to make payment in the manner selected by you. You also warrant to us that all information given by you to us through any booking method (including your name, contact and address details) is correct.

3.4 All cash transactions provided to the driving instructors will be issued with a written receipt at the time the cash is handed to the instructor.

3.5 A receipt for direct deposit can be requested from Highland School of Motoring office on 0419 119 323 or through the driving instructor or email.

4. Fees and cancellations/rescheduled bookings

4.1 You may cancel or reschedule your appointment without charge at any time 24 hours before your appointment.

If you cancel with less than 24 hours’ notice, the following applies:

            4.1. a  24 hours before scheduled appointment - No charge

            4.1. b  More than 4 hours but less than 24 hours - 50% of the scheduled lesson fee is charged

            4.1. c  4 hours or less including “no show” - Full fee price is charged

4.2 Highland School of Motoring reserve the right to reschedule a lesson subject to the provision of reasonable notice including telephone, email or msg. We reserve the right to refuse to provide a lesson where you are unfit to operate a vehicle as reasonably determined by us.

4.3 If you arrive late for a lesson the Instructor may only be able to offer you the remaining lesson time, if they are committed to another lesson after and you will be charged for the full lesson cost.

4.4 If you are more than 20 minutes late without notifying us, we reserve the right (at instructor’s reasonable discretion) to cancel the lesson and charge the lesson fee.

4.5 If you do not attend a lesson (No Show) we reserve the right to cancel the lesson and charge the full lesson fee.

5. Gift Vouchers

5.1 Are non-refundable, not redeemable for cash. Cancellation and promotional conditions apply.

6. Lessons

6.1 Driving lessons commence and end at the pre-determined pick-up/drop off point, established at the time of the lesson booking. The duration of a standard driving lesson is one hour, including lesson briefing and de-briefing.

6.2 Lesson durations are in accordance with our web page.

7. Provision of Lessons

7.1 You must hold a current Queensland Learners permit or equivalent overseas license and carry it with you at all times during a lesson.

7.2 Mobile phones will be switched off prior to entering the driving lesson.

7.3 You must be ready to commence the lesson 10 minutes prior to the agreed time. If you do not turn up at the agreed time for your lesson, your instructor will wait 15 minutes and may at the instructor's reasonable discretion deduct this from the total lesson time. If you turn up outside these times, your instructor may in his/her reasonable discretion choose not to proceed with the lesson and in such circumstances you will be liable for the cost of the lesson.

7.4 While every endeavour is made to commence the lesson at the scheduled time and with the scheduled instructor, no responsibility can be taken for circumstances beyond our control which may delay the start time or result in a change of instructor. If there are circumstances beyond our control which have delayed the start time of your lesson, we will offer you the full lesson time or, if that is not possible, we will offer you a lesson at another time. The instructor will make every reasonable effort to inform you of the situation.

7.5 You must comply with all reasonable instructions or directions of your instructor at all times, before and during a lesson.

7.6 We reserve the right to terminate a lesson if: 

7.6. a. you engage in any behaviour that your instructor determines is reckless; or

7.6. b. you fail to comply with the instructions or directions of your instructor before or during a lesson; or 

7.6. c. you fail to comply with any special conditions on your license, i.e. wearing of glasses/contact lenses; or

7.6. d. your instructor has assessed your driving skills and competence and deems you to be unfit or unsafe to drive, i.e. smelling of alcohol.

In the event that a lesson is terminated under the circumstances listed above you will be required to pay the full cost of the terminated lesson.

7.7 Your instructor will only arrange for you to sit your driving test if they deem you competent.

Vehicles

8.1 Use of own vehicle: If you are driving in your own vehicle, at the first lesson with  Highland School of Motoring the Instructor will assess that your vehicle is in a roadworthy condition (only a basic external inspection will be carried out). It is your responsibility to ensure that your vehicle is in a roadworthy condition. If it is not in a roadworthy condition it will not be used for the driving lesson.

8.2. Instructor Supplied Vehicle: Driving lessons are provided in manual vehicles only at this time.

8.3. Instructor supplied vehicles may contain global positioning and monitoring systems with the capacity to identify the location of the vehicle and the manner in which it is operated.

8.4 You will always be responsible for traffic infringement notices arising while driving our Vehicle.

9. Fitness to drive

9.1 If at any time you are assessed as unfit or unsafe to drive during a lesson, your instructor may terminate the lesson immediately and may assume control of the vehicle.

9.2 Because the safety of Instructors, participants and the general public is paramount, Instructors will not enter into any discussions with you regarding an unfit or unsafe driving assessment. If you wish to lodge a complaint about the way in which an assessment was made, please contact the Highland School of Motoring Office on 0419 119 323.

10. Privacy

10.1 Highland School of Motoring collects your personal information in order to provide lessons to you, to assess your driving skills and to assist in internal administration and operations including accounting, risk management, record keeping, archiving, systems development, testing, and staff training. Highland School of Motoring may use and disclose your personal information to related bodies only with your permission.

11. ACKNOWLEDGEMENTS

You acknowledge that:

  • The instructor has sole discretion as to whether a lesson will commence or continue;
  • The participation in a lesson does not guarantee that you will acquire the necessary skills to pass any driving test;
  • Driving a motor vehicle is an inherently risky activity and there is the risk of significant personal injury or damage to property;
  • We do not accept any liability whatsoever for personal property that is left in a vehicle; and
  • If you are not the learner, you have made the Learner aware of these acknowledgements.

Account Terms

This page contains the most current version of the Terms of Service.

  • Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  • You are responsible for all activity that occurs from your account.
  • You agree that Highland School of Motoring can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  • You must not post or submit false information to the Service.
  • You are responsible for maintaining the security of your account and password. Highland School of Motoring cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  • Highland School of Motoring has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Highland School of Motoring service, for any reason.
  • Violation of any of the terms or general conditions may result in the termination of your Account.
  • In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Highland School of Motoring has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Highland School of Motoring service. Such termination of the Service will result in the deactivation of your Account.

Cancellation Rates

  • Less than 12 hours notice before the booking will forfeit 50% of the booking fee.
A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Highland School of Motoring.

 

Modifications to Services and Prices

  • Highland School of Motoring reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  • Prices of all Services are subject to change with or without notice.
  • Highland School of Motoring shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Vouchers

  • Vouchers are non-refundable and cannot be redeemed for cash.
  • Unused vouchers can be transferred between clients.
  • Purchases containing multiple vouchers can only be used by a single person and cannot be split between people.

Fees

  • Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Highland School of Motoring for payment processing.
  • All fees and transactions are in Australian Dollars.

General Conditions

  • Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Highland School of Motoring.
  • Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Highland School of Motoring customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
  • You must not transmit any worms or viruses or any code of a destructive nature.
  • You understand that Highland School of Motoring uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  • Highland School of Motoring does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  • You expressly understand and agree that Highland School of Motoring shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Highland School of Motoring has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  • The failure of Highland School of Motoring to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  • You expressly understand and agree that Highland School of Motoring shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
